French Driving-School Approval: How to Obtain It in 2026 (Conditions, File, Deadlines)
Opening a driving school in France is not just a matter of registering a company and buying a dual-control car. Teaching driving for a fee is regulated by the French road-traffic code: the activity requires a prefectoral approval (agrément), provided for by article L. 213-1, issued for five years. Here are the conditions to meet, the content of the application file and the deadlines to plan for in 2026.
What the prefectoral approval covers
The approval authorises the operation of a driving and road-safety teaching establishment. It is issued by the prefect of the département where the school is located, for a renewable five-year period, and covers the categories of instruction actually delivered: car (category B), motorcycle, heavy-vehicle group… A school approved for category B only cannot launch a motorcycle or truck activity without having its approval extended.
It applies to every structure that charges for driving instruction: standard driving schools whatever their legal form, associations (under a specific regime), establishments preparing for professional licences (categories C, CE, D) and providers of post-licence training.
The conditions to meet before filing
The conditions are set by articles L. 213-1 et seq. and R. 213-1 et seq. of the road-traffic code, detailed by the order (arrêté) of 8 January 2001. They cover both the operator personally and the establishment’s resources.
On the operator’s side
- Be at least 23 years old;
- Meet a good-character requirement: no convictions for certain offences, in France or abroad;
- Prove the capability to manage the establishment: through the CQP (professional qualification certificate) « responsable d’unité(s) d’enseignement de la sécurité routière et de la conduite », or through a higher or technical education diploma in law, economics, accounting or business.
A frequently misunderstood point: the operator does not need to be an instructor. However, every teacher in the school must hold their own teaching authorisation, issued by the prefect — it is a condition of the establishment’s approval.
On the establishment’s side
- Suitable premises, evidenced by a lease or title deed;
- Compliant vehicles for the categories taught (registration document or purchase order in the file);
- Adequate material and teaching resources for the courses offered;
- A compliant teaching team, each instructor holding a valid teaching authorisation.
The file and the procedure
- Assemble the file: application form, identity and good-character documents, proof of management capability, premises documents, vehicle documents, list of instructors with copies of their teaching authorisations. The exact list appears in the order of 8 January 2001 and on your prefecture’s website.
- File with the prefecture of the département of establishment. Many prefectures now require online filing through a dedicated portal: check the local channel before sending anything on paper.
- Processing: prefectures announce a two-month period from receipt of the complete file. Beware: under this regime, the administration’s silence beyond the deadline counts as a rejection — no answer never means tacit approval.
- Decision: if granted, the approval is issued for five years; if refused, the decision is reasoned and notified, and can be challenged through the usual administrative remedies.
Time is won on completeness: the clock starts with a complete file, and every missing document pushes the date back. Treat the file as a list of proofs: one requirement, one supporting document.
After approval: the obligations that follow
Once approved, the operation remains supervised: display obligations (courses, prices), a written contract with every learner, administrative tracking of training delivered, and declaration to the prefecture of any change — premises, operator, categories taught. Failing these obligations can lead to a suspension or withdrawal of the approval.
Also keep the scheme’s fundamental limit in mind: the approval authorises, it does not fund. This tight regulation of the trade is not a French quirk: road-safety research stresses that driver training only improves safety under quality conditions. The review by D. Mayhew and H. Simpson, “The safety value of driver education and training”, published in 2002 in Injury Prevention, shows that training does not mechanically produce safer drivers and argues for demanding standards of content and supervision (see the study).
