ORIAS Renewal: The Annual Calendar and Grounds for Strike-Off

Registration in the French register of insurance, banking and finance intermediaries is not a permanent acquisition. It is renewed every year, in a short window, and a missed renewal leads to a strike-off that simply bars the activity. It is the most mundane deadline in the trade, and one of the costliest to miss.

An annual duty written into the codes

The principle of annual renewal, on pain of strike-off, appears in both codes governing intermediation: articles L. 512-1 and R. 512-5 of the Insurance Code for insurance intermediation, and articles L. 546-1 and R. 546-3 of the Monetary and Financial Code for intermediaries registered for banking and financial activities.

In practice the step is completed online, on the ORIAS website, in the window the organisation opens at the start of the calendar year. It must be done before 1 March. Every registered intermediary, whatever their categories, faces the same deadline.

It is not a simple address confirmation. Renewal is the moment when ORIAS re-checks that the registration conditions are still met.

What ORIAS re-checks

Three conditions account for most blockages.

Professional indemnity insurance. The certificate must be valid for the year concerned. An expired certificate, or one in the name of an entity that is no longer the right one after a restructuring, blocks the file.

The financial guarantee, where the intermediary handles funds on behalf of third parties. A change in the business model during the year — a firm that starts collecting premiums — must be reflected in the file.

Membership of a professional association approved by the ACPR, for insurance brokers, banking and payment services brokers and their agents, subject to statutory exceptions. This requirement comes from law no. 2021-402 of 8 April 2021, the brokerage reform, and its verification by ORIAS at renewal took many firms by surprise when it was first applied.

Updating declared information — managers, categories, contact details, legal form — completes the exercise.

Why an annual check makes sense

One could see this appointment as redundant paperwork. The economic literature on the distribution of financial products suggests otherwise.

Roman Inderst and Marco Ottaviani, in “Misselling through Agents”, published in 2009 in the American Economic Review, model the conflict inherent in the intermediary’s role: the same person must prospect for customers and advise on whether the product suits their actual needs. The authors show that the equilibrium amount of misselling depends closely on how the sales process is organised, on the transparency of the commission structure and on the steepness of sales incentives (see the study).

In other words: the risk is not a one-off, it is structural and permanent. A single check at entry does not cover it. Annual renewal, mandatory financial cover and membership of an association tasked with monitoring its members form a maintenance system rather than an entry filter — the same logic that underpins the annual continuing-training duty.

Calendar traps

Waiting for the last week of February. The renewal window is the period when the entire sector logs into the same service. A missing document discovered on 25 February leaves little room.

Forgetting that documents depend on third parties. An indemnity certificate is requested from an insurer; association membership requires an application and processing time. Those lead times do not compress.

Treating renewal as an isolated task. For a firm with several categories, or a network with many agents, the workload has to be prepared upstream: listing the registered persons, collecting certificates, checking memberships.

Overlooking a change of situation. A change of manager, a corporate reorganisation, a new brokerage activity: each affects the renewal file. Better to update the register during the year than to discover the gap in February.

What a strike-off entails

Strike-off for non-renewal is not a disciplinary sanction: it is automatic. Its effects are nonetheless immediate and heavy.

Intermediation may no longer be carried on. Acting without registration is a criminal offence under the Insurance Code and the Monetary and Financial Code, and the ACPR also has its own enforcement powers.

The commercial consequences arrive faster than the sanction. Insurers and lenders check the register: a strike-off means partnership agreements are suspended, commissions stop and files in progress are handed back.

Returning to the register requires a fresh application, with the full set of supporting documents — which takes time, during which the business stands still.

A routine to set up once and for all

Three habits neutralise the risk.

Diarise the window in January, for every person concerned in the firm.

Align the deadlines. As far as possible, aligning the renewal dates of the indemnity policy and of the association membership with the calendar year avoids chasing certificates out of step.

Keep a standing file: current certificates, continuing-training records, up-to-date articles of association, list of persons involved in distribution. That file serves the renewal, but also any inspection — and it divides by ten the time spent each winter.
