French estate agency licence (Hoguet law) — T, G and S endorsements

Mandatory: French law no. 70-9 of 2 January 1970, known as the Hoguet law, reserves property brokerage and management activities to licence holders. Practising without a licence is a criminal offence under article 14 of that law.

Who it concerns

Any individual or company habitually acting as an intermediary in, or managing, property and business assets: sales agencies, letting and property managers, block managers (syndics), sellers of property listings. Their staff need a separate authorisation certificate.

Scope

What this scheme covers

  • C.1Endorsements that define the authorised activity: “property and business transactions” (T licence), “property management” (G licence), “block management” (S licence), plus the “list seller” and “tourism services” endorsements.
  • C.2Four cumulative conditions: professional aptitude (qualification or experience), good repute, professional indemnity insurance and, as soon as client money is handled, a financial guarantee.
  • C.3A three-year validity, renewable, conditional on the continuing-training duty introduced by the ALUR law: 14 hours a year or 42 hours over three consecutive years.
  • C.4An enforceable ethical framework: the code of conduct for property professionals set by decree no. 2015-1090 of 28 August 2015, breaches of which can trigger disciplinary sanctions.
  • C.5Public visibility: holders appear in the national register of property professionals maintained by CCI France and searchable online.
How it fits

The link with Qualiopi

The licence authorises a property occupation and has nothing to do with Qualiopi. The bridge lies elsewhere, and it is a strong one: the ALUR continuing-training hours are delivered by training providers, and those seeking public or pooled funding for them need Qualiopi certification.

How to proceed

The process, summarised

  1. 1.Determine which endorsements are needed (T, G, S, list seller, tourism services) in light of the activities actually carried out and the company's objects.
  2. 2.Evidence professional aptitude: a law, economics or business degree at bachelor level or above, the BTS in property professions or an equivalent qualification; failing that, ten years' experience in a Hoguet-regulated role, cut to four years for a managerial role (articles 11 to 14 of decree no. 72-678).
  3. 3.Take out professional indemnity insurance and, where client money is handled, a financial guarantee from an approved guarantor; where no money is handled, a declaration of non-handling is filed instead.
  4. 4.File the application (Cerfa form 15312) with the territorial CCI of the registered office, together with proof of good repute, aptitude, insurance and guarantee.
  5. 5.Request an authorisation certificate (Cerfa form 15315) for every employee or self-employed negotiator acting on the licence holder's behalf.
  6. 6.Complete the required continuing training and file the renewal application within the two months preceding expiry, failing which the holder is removed from the national register.
Frequently asked questions

FAQ — Estate agency licence

+Does a self-employed negotiator need their own licence?

No, provided they work on behalf of a licence holder: they then need an authorisation certificate issued by the CCI at that holder's request. As soon as they act as an intermediary in their own name and for their own account, however, the licence becomes mandatory.

+Can you obtain the licence without a property qualification?

Yes, through experience. Decree no. 72-678 recognises professional aptitude after ten years of employment in a Hoguet-regulated activity, reduced to four years where the role was a managerial one. The supporting evidence is closely defined: have your CCI confirm it before building the file.

+What happens if the ALUR training hours have not been completed?

Renewal is refused: the training certificate is one of the required documents. Once the licence has expired, the holder is removed from the national register and continuing to trade amounts to unlicensed practice under article 14 of the Hoguet law. The hours must cover the occupation's skills and include at least two hours on non-discrimination in access to housing and two hours on the other ethical rules.
